Dear,

It looks like it is somewhere upstream of the 5' UTR (untranslated region). So it is neither. Try to check where the promotor is.

Why not check dbSNP?

NearGene-5 is thefunctional class which means that the SNP is within 2kb 5' to a gene. So as already pointed out, the answer is 'neither'.
