It's hard to comment on this because you haven't specified the methodology, and therefore no one can evaluate your methods for potential confounders.

I suspect you are defining "conserved" as sequence conservation underlying a human cCRE. But even with sequence conservation the functional activity may fail to be conserved, and visa versa. It may be appropriate to restrict attention to cCREs that show activity in both human and mouse.
